Compliance with the law problems about social protection of persons with disabilities

Annotation:

Introduction. Persons with disabilities are one of vulnerable categories of the population in social aspect.
Identification of problems of application of the legal regulation of this sphere of public relations is relevant for ensuring efficiency of social protection of persons with disabilities.

Aim. The purpose of the work is to definite system shortcomings of implementation of the social legislation providing equal rights of persons with disabilities.

Materials and Methods. Publications of the Commissioner for Human Rights in the Russian Federation and Commissioners for Human Rights in territorial subjects of the Russian Federation, results of sociological and economic researches, publications of the non-state organizations which are engaged in protection of the rights of persons with disabilities were analysed. When carrying out a research also other methods of knowledge were applied such as dialectic, logical, legallistic.

Results. The conducted research revealed system shortcomings of implementation of the legislation on social protection of persons with disabilities regulating carrying out medico-social examination, ensuring accessibility of the environment, drawing up and implementation of the individual program of rehabilitation and abilitation, implementation of medical rehabilitation, providing provision of free medicines and sanatorium treatment, providing persons with disabilities with technical means of rehabilitation, the organization of education of persons with disabilities, employment of persons with disabilities, social security in connection with disability, granting housing privileges, stationary social service, keeping of persons with disabilities in institutions of penal system.

Conclusions. Now there are several system problems of application of the legislation considerably interfering realization of the rights of persons with disabilities in the sphere of social protection. Their decision requires increase in financing from the federal budget, toughening of control of target use of means, increase in legal responsibility for violation of the rights of persons with disabilities, elimination of gaps of legal regulation, economic and legal support of introduction of innovative forms of social support of persons with disabilities.
